Before you register with rappidApp, you must read and agree to the following Terms of Service. By registering for and / or using www.getrappidApp.com and/or the rappidApp services (collectively the “Service”), you agree to these Terms of Service, including our Privacy Policy, and you agree that the Terms of Service are enforceable as if it were a written agreement signed by rappidApp and you. By using the Service, you further agree to comply with all applicable laws and regulations. You also agree to not in any way alter or tamper with the software on or the operations of this website or in any way compromise the security of this website or the Service. You may not use the Service if you do not agree to any of these Terms of Service. rappidApp reserves the right to change or update these Terms of Service at any time without prior notice. Your continued use of the Service after any changes to the Terms of Service constitutes your consent to those changes. Your use of the Service is subject to the most current version of the Terms of Service posted on this website at the time of such use.

Service Information and Disclaimer rappidApp is a web-based content management platform allowing creation and deployment of mobile apps. The Service, applications, and site content are provided “AS IS” and “AS AVAILABLE” and without any express or implied warranties, including implied warranties of title, merchantability, fitness for a particular purpose or non-infringement. Further, rappidApp does not warrant that the material on this website is complete or current or that the Service will operate error-free, uninterrupted, or with any other software, hardware, or systems. You understand and agree that your content may be transmitted unencrypted over the internet, with the exception of personally identifiable information, such as credit card numbers. The Service may be temporarily unavailable from time to time and rappidApp assumes no responsibility for any error, omission, defect, delay or interruption caused by such unavailability. rappidApp reserves the right to change or update any information or content on this website or relating to the Service at any time without prior notice, including, but not limited to, the price, description and availability of any and all services. rappidApp is not obligated to add to, modify, supplement or delete any of the contents of this website. rappidApp assumes no responsibility for any errors or omissions in the material on this website. By accessing this website and/or using the Service, you agree that in no event will rappidApp be liable for any damages, including, but not limited to, special, indirect or consequential damages resulting from any use or performance of, or content errors or omissions in the material, even if notified in advance of the potential for such damages.  In no event shall rapidApp be cumulatively liable for monetary damages in excess of the fees paid by you to rapidApp for use of the Service.  The disclaimers in this section may not apply to you in whole or in part due to prohibitions of some disclaimers in your jurisdiction, but shall apply to the maximum extent permitted in your jurisdiction.  

Eligibility and Account Security

rappidApp retains the right to refuse service to or cancel the account of anyone at any time for any or no reason at all. You must be at least eighteen (18) years of age to use the Service. In order to use the Service you must provide accurate, current, and complete information as may be required from you as part of the registration process or continued use of the Service. Further, you agree to update and keep current all information provided to rappidApp. You are responsible for maintaining the security and confidentiality of your Service account and password and you understand that you are solely responsible for any and all actions that occur under your account.

User Conduct

You agree and warrant that no materials of any kind submitted or transmitted by you will violate the rights of any third party, including, trademark, copyright, patent, trade secret, privacy or any other proprietary right. You further agree that you will not submit or transmit any content that is unlawful, fraudulent, libelous, defamatory or otherwise objectionable as determined by rappidApp in its sole discretion. You agree that you will not use any manual process or automated scripts to collect, monitor, or copy any content or information from the website or the Service.  Upon payment to rapidApp and your continued compliance with these Terms of Service, your use of the Service is limited to your non-exclusive use for your internal business operations, including affiliated entities.  You may not license or sell or otherwise charge third parties for access or use of the Service without the written consent of rapidApp.  

Payment

New, unregistered users are entitled to a one-time 30-day free trial of the Service. After the expiration of the 30-day free trial, a valid credit card is required to continue use of the Service.
Monthly: Users that subscribe to a month-to-month term of the Service will be billed in advance on a monthly basis. Each monthly payment is NONREFUNDABLE regardless of cancellation, partial months of service, or changes to the account.
Yearly: Users that subscribe to a yearly term of the Service will be billed in advance on a yearly basis. Upon successful cancellation of your account, you can request a refund for the remaining full months in that billable yearly term by contacting rappidApp at (912) 544-1770 or support@getrappidApp.com.

Cancellation

You may cancel your account at any time by signing in to your administrative account, clicking on the “settings” tab, clicking on the “Pricing Plans” and clicking the “Delete My Account” link at the bottom of the page. You will be asked to confirm the cancellation. You must continue processing your cancellation until you receive the final cancellation confirmation page. If you stop this process prior to receiving that page, your cancellation will not be processed. THIS IS THE ONLY ACCEPTABLE METHOD TO CANCEL YOUR ACCOUNT. There is no cancellation fee.
IMPORTANT: You are responsible for the full fee amount for the month in which you cancel. No refund will be provided if you cancel before the end of the current, paid for month. Cancellation will be immediate.

rapidApp reserves the right to cancel your account at any time for any reason.  

Refund

There will be no refunds for any reason, except as noted above for yearly subscriptions. The Service provided by rappidApp is sold “AS IS” without any guarantee or warranty of any kind. By purchasing the Service, you are confirming that you have read and understand our NO REFUNDS policy.
Intellectual Property Notice
rappidApp has gone to considerable expense and effort to design and construct this website and the Service. rappidApp grants to you permission to electronically copy and to print portions of this site to the extent that it is necessary for use of the Service. Otherwise, you may not copy, display, distribute, download, modify, post, transfer, or transmit this website or its contents, including images, designs, icons and photographs, without the prior written permission of rappidApp. All materials contained on this website are either owned or licensed by rappidApp. The materials on this website are copyrighted or trademarked and any unauthorized use of these materials may violate copyright, trademark or other laws. ALL RIGHTS RESERVED.

By posting, transmitting or otherwise providing materials of any kind to rappidApp, you grant rappidApp an irrevocable, non-exclusive, perpetual license to use, copy, display and distribute such material on or in connection with www.getrappidApp.com and/or the Service for all purposes as deemed necessary by rappidApp, including, but not limited to, commercial, advertising and promotional purposes. Subject to the above license, rappidApp does not assert ownership over any materials posted, transmitted or otherwise provided by you to rappidApp.
rapidApp is and shall remain the sole and exclusive owner of the Service and all software and proprietary information related to the Service.

You agree to hold harmless, indemnify and defend rappidApp, and each of its affiliates and related entities, directors, officers, employees, agents and insurers from and against any and all claims, actions, causes of action, demands, or other proceedings arising out of, related to, or connected with your use of the Service, including but not limitied to attorneys’ fees, costs, expenses of litigation, and any other monetary costs incurred by rapidaApp or others on behalf of rapidApp.  rapidaApp shall have the sole and exclusive right to select its own counsel in any proceeding arising under this provision and otherwise..

Applicable Laws

These Terms of Service shall be governed, construed, and enforced in accordance with the laws of the State of Georgia. You agree that any dispute arising out of or relating in any way to this website will be brought exclusively in the Federal or State courts located in Chatham County in the State of Georgia.

In the event that any portion of these Terms of Service shall be determined to be invalid or unenforceable, the remainder of these Terms of Service shall be deemed to continue to be binding in the same manner as if the invalid or unenforceable portion of the Terms of Service was not included. Failure of rappidApp to exercise or enforce any part of these Terms of Service does not amount to a waiver of any right or provision herein.
